MOUNTAIN HOME -- A Mountain Home airman has been charged with first-degree murder in the death of his 22-month-old stepson.

Prosecutors in Elmore County filed the murder charge today against 20-year-old Richard Laubach.

Mountain Home Police got a call Tuesday afternoon that a young boy was injured and unresponsive.

Laubach was arrested Tuesday night after his stepson was brought to a Boise hospital for care. The toddler died from his injuries the next morning.

Ada County Coroner Erwin Sonnenberg has identified the victim as Joseph Wayne Graham of Mountain Home. He performed an autopsy today and lists the cause of death as abusive head injury with the manner being homicide.

Police said they thought the boy was injured in a fall, but there appeared to be more to it.

Laubach was originally charged with felony injury to a child.

This is not the first time Laubach has been in trouble with the law.

According to court records, Laubach was arrested by Mountain Home authorities in August 2012 on charges of domestic violence and injury to a child. Those charges were dismissed in December after Laubach completed an anger management program, parenting courses and two sessions of marital counseling.

Elmore County prosecuting attorney Kristina Schindele says those incidents last summer involved the same boy and his wife.

She says the crime of first-degree murder is a death penalty offense, but prosecutors have not decided whether to seek it in this case.

A judge ordered Laubach be held without bond and assigned him a public defender. He is due back in court Friday.
