EUGENE, Ore. (AP) — Eugene city prosecutors say police didn't do anything improper in arresting a driver suspected of DUII even though her breath test showed a blood alcohol content of .01 percent — well below the state limit of .08.

Police suspected 23-year-old Leah Bailey was under the influence of marijuana last October after she was stopped for crossing into a bicycle lane.

She said she had one beer at a party but no drugs. Urine test results the next month showed she was telling the truth. The charge was dismissed last week in Eugene Municipal Court.

Bailey did plead guilty to crossing into a bike lane and paid a $200 fine. She also had to pay $250 to get her car back after her arrest.
