POCATELLO, Idaho (AP) -- Charges have been dismissed against an eastern Idaho man suspected in a shooting at a Pocatello coffee shop because he's unfit to stand trial.
The Post Register reports that felony charges against Gerald Durk Simpson of Pocatello were dismissed Aug. 30.
Simpson was charged with felony aggravated battery with a deadly weapon enhancement after police say he shot Ryan Mitchell in the back outside a Pocatello coffeehouse in September 2010.
The dismissal order states Simpson lacks the capacity to make informed decisions about his case and treatment.
Police say Simpson did the shooting soon after being removed from a state mental health program. The program through Idaho Health and Welfare saw reductions in July 2010 because of state budget cuts.
