Tamarack homeowners win round one in battle to open resort

BOISE - After a longer than expected deliberation, Judge Patrick Owen issued his ruling on a proposal by some Tamarack homeowners to reopen the resort.

The West Mountain Perservation Management Association (WMPMA) says it has secured nearly $8 million from a Mexican investor and wants to open Tamarack for ski season. In order to access that money and reopen the resort, it must first put another receiver in charge of Tamarack.

The judge's 9-page ruling grants the homeowner's motion to intervene, "so it can present its motion for the appointment of a receiver," wrote Owen. "The decision to permit intervention is not intended to express, and does not express, any view that the court will appoint a receiver as requested."

The next step for WMPMA is to present its case for appointing a receiver to manage the resort.

Credit Suisse, and numerous other lein holders who are owed hundreds of millions of dollars, oppose this strategy because they would be bumped down in payment priority.

Tamarack closed its resort and all amentities on March 4, 2009.
