BOISE -- U.S. District Magistrate Candy Dale has denied Governor C.L. "Butch" Otter's request for a stay on her decision to lift the ban on gay marriage in Idaho.

Dale ruled the ban unconstitutional Tuesday. Her denial of Otter's stay request means the ban will be lifted and gays and lesbians in Idaho will be free to marry starting at 9 a.m. Friday.

Attorney General Lawrence Wasden has also filed a stay in the case, and Otter will likely appeal Dale's decision to higher courts.
